GAS cleared to promote Crusty Tour

Global Action Sports (GAS) has today landed a critical blow in its ongoing dispute with Fleshwound Films (Fleshwound) over Fleshwound’s attempt to illegally terminate the long term licence with GAS’s subsidiary, Rush Sports and Events International (“Rush”) to promote the Crusty Demons live shows internationally.  

In early September Fleshwound brought a motion through the Californian arbitration process to attempt to restrain Rush from using the Crusty Demons trademark and to stop it from running its Crusty Demons Beyond the Apocalypse Regional Tour.  

The arbitrator today decided to preserve the status quo and in doing so has cleared the way for Rush to continue with its Crusty Demons tour without further interference from Fleshwound.

“We have known from the beginning that we had right on our side in this case and it’s very pleasing to have this vindicated by the Californian arbitrator,” said Michael Porra Managing Director of GAS.

“As I have said from the start of this dispute, we have poured so much time and money into building the Crusty Demons live shows into what they are today and have greatly strengthened the Crusty Demons brand through our highly successful shows and promotion of them. There was no way that we would walk away from the brand we helped create.

“The final hearing for this dispute will take place in due course and we are extremely confident of a positive outcome there too,” Porra concluded.

A win for Rush in the final hearing will formally confirm Rush’s current position as the long term exclusive license rights holder to promote the Crusty Demons live shows and will also more than likely require Fleshwound to pay Rush a substantial award of damages.

In the meantime Rush continues its separate actions against Fleshwound principals, Jon and Cami Freeman, through the Californian courts in connection with their breach of a non-solicitation and non-interference clauses and their stealing of Rush’s trade secrets as well as a separate action against former GAS contractor Adam Bray in Australia.

Rush will continue promoting the 2010 Crusty Demons Beyond the Apocalypse Regional Tour, which is already on sale.
